I. INTRODUCTION

Amber (“I”, “me” or “my”) takes your privacy seriously. This Privacy policy (“Privacy policy”) explains my data protection policy and describes the types of information I may collect from you or that you may provide when you use MusicFMPop (the “App”) and explains how I cooperate with, collect, use, maintain, protect and disclose that information.

When I refer to personal data (or personal information) I mean any information of any kind relating to an identified or identifiable natural person.

It is a natural person who can be identified directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social status.

My Privacy policy applies to all users, and others who access the App (“Users”).

For the purposes of the GDPR, I am the data controller.

BY ACCESSING OR USING THE APP, YOU AGREE TO THE COLLECTION, USE AND TRANSFER OF YOUR PERSONAL DATA WHICH IS PROVIDED TO me IN LINE WITH THE TERMS OF THIS PRIVACY POLICY.

II. CHANGES TO THE PRIVACY POLICY

This Privacy policy may change from time to time. Whenever I change this Privacy policy, I will post those changes to this Privacy policy and other places that I consider appropriate. Additional forms of notice of modifications or updates as appropriate under the circumstances may be provided to you.

You agree that your use of the App following any modifications and updates to this Privacy policy indicates your consent to such modifications and updates as well as your consent to the revised Privacy policy. For the reasons above, please check the Privacy policy periodically for updates.

III. SCOPE AND CONSENT

Before you start using the App, it’s very important you understand that by using the App, you give me consent to collect, use, disclose, and retain your personal information. The consent you make is a legal basis for the processing your personal information. You can be sure that I will only use your information as described in this Privacy policy.

The App is developed based on the technologies which involves data processing. Unfortunately, disabling these technologies means my inability in providing you with my products (including the App) or services involving the App.

By using the App, you are also agreeing to my Terms of Use. Please make sure you read and agree with my Terms of Use if you want to use the App.

You are not required to provide your personal information, but, if you choose not to do so, I will not be able to provide you with my products (including the App) or services or respond to any queries you may have.

IV. INFORMATION I COLLECT ABOUT YOU AND HOW I COLLECT IT

The minimum of your personal information required to achieve the purposes set out in this Policy (see below) is collected by me.

You have the ability to limit such collection, as specified below under “YOUR PRIVACY CHOICES”.

I collect the following types of information:

  • Information you provide me directly: e-mail;
  • Information I collect through automatic data collection technologies.

I use third-party automatic data collection technologies (analytics tools) to collect certain information sent by your device or my App. The information I collect automatically may include personal information. Automatic data collection technologies (analytics tools) provide me with the data described below.

Device identifiers:
When you use a mobile device (a tablet or a phone) to access my App, I may access, collect or monitor one or more “device identifiers.” Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. Device identifier provides reports or personalized content and ads.

I collect:

  • Type of your mobile device and operational system version which is installed on your mobile device;
  • Region information of your mobile device;
  • IDFA (Identity For Advertisers) which is a string of numbers and letters that identifies your individual smartphone or tablet;

Some features of the App may not function properly if availability of device identifiers is impaired or disabled.

Cookies and similar technologies:

When you use the App, I may use cookies and similar technologies like pixels, web beacons, scripts to collect information about how you use my App and provide features to you.

A cookie is a text file containing small amounts of information which is downloaded to your device when you access the App. The text file is then sent back to my server each time you use the App.

This enables me to operate the App more effectively. For example, I will know how many users access a specific areas or features within my App and which links or ads they clicked on. I use this aggregated information to understand and optimize how my App is used, improve my marketing efforts, and provide content and features that are of interest to you.

I may ask advertisers or other partners to serve ads or services to the App, which may use cookies or similar technologies.

Log file information:

Log file information is automatically reported each time you make a request to access (i.e., launch) the App. It can also be provided when the App is installed on your device.

When you use my App, analytics tools automatically record certain log file information, including your web request, Internet Protocol (“IP”) address, and how you interact with the App.

To the extent that IP addresses or similar identifiers may be considered personal information by local law, I also treat these identifiers as personal information.

Collecting information through automatic data collection technologies starts automatically when you start using the App.

The App may use automated processing of your personal data, including profiling (any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to you, in particular to analyze or predict aspects concerning your personal preferences, interests, behavior, location or movements).

By using the App, you give me your explicit consent to be subject to a decision based on automated processing, including profiling.

V. THE PURPOSES OF THE COLLECTING AND PROCESSING YOUR PERSONAL DATA

I want my App to be the handiest for you. That is why I need some of your personal information.

For the reasons above, the purposes for the processing your personal data are:

  • my App improvement guided by the marketing statistics, which I take from analytics tools information provided by automatic data collection technologies of the third parties, mentioned in this Privacy policy.
  • marketing purposes (interest-based (behavioral) advertising or other targeted content) provided by automatic data collection technologies.

Information you provide me directly is used for providing you with notices.

All the information I collect through automatic data collection technologies I use for:

  • estimating my audience size and usage patterns, measuring traffic and usage trends for the App in order to improve it.
  • providing you with interest-based (behavioral) advertising or other targeted content.

If any new purposes for collecting and processing your personal data arise I will let you know I start to collect and process information on that other purpose by introducing the corresponding changes to this Privacy policy.

VI. HOW I USE YOUR PERSONAL DATA

I use your personal data to:

  • provide you with information that you have consented to receive;
  • diagnose or fix technology problems;
  • provide, improve, test, and monitor the effectiveness of my App;
  • monitor metrics such as total number of users, traffic, and demographic patterns;
  • provide personalized content and information to you, which could include online ads or other forms of marketing;
  • automatically update the App on your device;
  • For any other purpose with your consent.

Where I collect information by way of feedback, a survey, or research activities, this will only be published anonymously as a combination of responses, rather than individually, unless otherwise agreed with you.

VII. DISCLOSURE OF YOUR INFORMATION

I will share your information with third parties only in the ways that are described in this Privacy policy.

I will not rent or sell your personal data to third parties without your consent, but I may share your information from tools like cookies, log files, and device identifiers and location data, with third-party organizations that provide automatic data collection technologies for the App.

I do not control or influence these third parties’ tracking technologies or how they may be used.

I may also share certain information such as cookie data with third-party advertising partners.

This information would allow third-party ad networks, inter alia, to deliver targeted advertisements that they believe will be of most interest to you.

my App may contain links to third-party websites/services or you may access the App from a third-party site. I am not responsible for the privacy practices or the content of these third-party sites or services linked to or from my App, including the information or content contained within them.

I may remove parts of data that can identify you and share anonymized data with other parties.

I may also combine your information with other information in a way that it is no longer associated with you and share that aggregated information.

Also I may disclose your personal information

  • as required by law.
  • when I believe in good faith that disclosure is necessary to protect my rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
  • if I am involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on my Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

VIII. INTERNATIONAL DATA TRANSFERS

I work in the international space and provide my App to Users around the world.

Me and third-party organizations that provide automatic data collection technologies for the App or my third-party advertising partners may transfer information that I collect, including personal information, across borders and from your country or jurisdiction to other countries or jurisdictions around the world.

If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that I may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as in your jurisdiction.

This means that your personal information can be transferred to a third country, a territory or one or more specified sectors within that third country, or to the international organization where data protection and confidentiality regulations may not provide the same level of protection of a personal data as your country does.

I try to make sure that the recipient of any personal data provides a proper protection of the personal data received, in accordance with the current legislation on the protection of such information.

Even though before (or while) using the App you fully aware of the fact that it is not always possible for me to make sure that any recipient who can get your personal data is able to provide appropriate safeguards, and it can lead to your personal data unsafety and the absence of effective legal remedies for you as well as possibility of using this data by such recipients for the purposes not mentioned it the Privacy policy.

By using the App, you give me your explicit consent to the possibility of transferring your personal data to any third country, a territory or one or more specified sectors within that third country, or to the international organization. You fully demonstrate that you are informed of the possible risks of such transfer due to the absence of appropriate safeguards and the lack of effective legal protection, including legal acts, instruments and remedies.

IX. HOW LONG I USE YOUR PERSONAL DATA

There are certain reasons described above that I have to keep hold of some of your information.

Naturally I store your information while you are using the App so that I am able to provide the services to you. I also keep storing your information after you’ve stopped using my App, for as long as I need it, depending upon the type of information and the purpose set out in this Privacy policy or as is required by applicable law, and then I will erase it.

Thus, whenever there is no specific legal requirement, the data will be stored and kept only for the minimum period necessary for the purposes for which it was collected or further processed.

X. YOUR PRIVACY CHOICES

a) Without affecting the lawfulness of processing based on your consent before its withdrawal, you can withdraw (cancel) your consent to the processing of your personal data for one or more specific purposes anytime you want by sending me your request. If I receive such a cancellation notice from you it will mean that you want to disable the technologies which involves data processing. In such a case I will not be able to provide you with my products (including the App) or services involving the App, and your decision to withdraw your consent may require that you uninstall the App from your mobile device.

b) You may make a request to access your personally identifiable information that’s stored by me and maintained in my database, including the categories of your personal data concerned and the purposes of the processing.

c) If you believe the information I process on you is inaccurate you can request me to correct it according to the data which you provide me.

d) You can request erasure of personal data concerning you without undue delay, and I will do it if it is technically feasible and there is no legal ground for me to keep processing your personal data.

e) You can request restriction of processing of personal data concerning you (it means that processing of your personal data will be blocked or suppressed).

f) You can object to the processing of your personal data. It means that I must stop processing your personal data for direct marketing purposes anytime as soon as I receive your objection and I cannot refuse.

g) You can request me to transmit your personal data directly to another organization. I will do it if this is technically feasible. However, I am not required to adopt or maintain processing systems that are technically compatible with other organizations.

In each case when I am to provide information I will reply at the earliest possible time but not later than within a month from the date when I receive your request. If your requests are complex or numerous I reserve the right to extend the period up to two months for investigation, giving you proper information and taking an action when needed. Where requests are manifestly unfounded or excessive, in particular because they are repetitive, I can charge a reasonable fee for processing you request.

If there is no response to your request within the reasonable time period or if you are not satisfied with my response or believe I am processing your personal data not in accordance with the law you can complain to a supervisory authority.

As you already know I may use automated decision making and profiling technologies in my App. I notify you that you have the right to ask me to stop using such technologies, however it will mean that you want to disable the technologies which involve data processing. In this case I will not be able to provide you with my products (including the App) or services involving the App, and your decision to withdraw your consent may require that you uninstall the App from your mobile device.

Residents of the State of California (USA) have the right to request a list of all third parties to whom my App disclosed certain personal information (in accordance with the laws of the State of California) in the previous year for the purposes of direct marketing of such third parties. . When submitting such a request, please include in the text of your appeal the wording “Your rights to maintain confidentiality in the state of California”, as well as your name, address, city, state, and zip code. In the text of your request, please provide me with sufficient information so that I can determine if the above requirements of the law apply to your situation.

You must confirm that you are a resident of the State of California (USA) and provide the current address in the state of California for my response. Please note that I do not accept calls by phone, mail or facsimile, nor are I responsible for calls that are flagged or misdelivered or that do not contain exhaustive information.

XI. SECURITY

The security of your personal information is important to me. I follow generally accepted industry standards to protect the personal information submitted to me, both during transmission and once I receive it.

I take reasonable and appropriate measures to protect personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the risks involved in the processing and the nature of the personal information.

I implement appropriate technical and organizational measures, which are designed to implement data-protection principles, such as data minimization, in an effective manner and to integrate the necessary safeguards into the processing. I seek your personal data to be encrypted with proper and strong encryption algorithms, including hashing where possible.

Unfortunately, no method of transmission over the Internet, or method of electronic storage, is 100% secure. I do my best to protect your personal data, nevertheless, I cannot guarantee its absolute security. In the event that your personal information is compromised as a breach of security, I will promptly notify you in compliance with applicable law.
